HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.28495 of 2017 ORDER:
Heard learned counsel for the petitioners.
The petitioners claim that they are the joint owners of the land of an extent of Acs.24.80 cents situated in Survey No.346/3-1 of Surayapalem Village, Podalakuru Mandal, SPSR Nellore District. They state that it is their ancestral property. Out of the said land, the petitioners are having Acs.13.75 cents. In view of the dispute among the joint owners, O.S.No.73 of 2014 was filed for partition and separate possession of the share of the petitioners before the Court of the VII Additional District, Gudur, and the same is pending. In the meanwhile, the petitioners stated that a draft notification was issued for acquisition of portion of the land for Telugu Ganga Project. It is their further claim that if the compensation is paid to the other joint owners excluding their claims, they would suffer serious loss.
In those circumstances, they stated that they issued notices on 01.01.2017 and 22.05.2017, and in spite of the same, when there is no reply, the present writ petition is filed. The representations alleged to have been sent to the third respondent are filed along with the material papers in the writ petition. In respect of the representation dated 22.05.2017, the postal receipt sending the representation by the Registered Post is also filed. In the circumstances, the third respondent is directed to consider the said representation and take action in accordance with law, if any portion of the lands claimed by the petitioners is involved in the acquisition.
The writ petition is accordingly disposed of.
