THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.6773 OF 2017 ORDER:
The grievance of the petitioner in the present writ petition is non-disposal of the appeal filed by him on 20.08.2016, against the order of suspension of fair price shop authorization dated 06.07.2016, passed by the 3rd respondent- Revenue Divisional Officer.

Heard learned counsel for the petitioner and learned Government Pleader for Civil Supplies for the respondents. 3.
Petitioner herein is a fair price shop dealer of Lingaraju Agraharam Village, Nellore District. On the ground of certain alleged variations in stocks, the Revenue Divisional Officer, Kavali, placed the petitioner under suspension pending enquiry. Aggrieved by the said order of suspension, petitioner herein preferred appeal before the Joint Collector - 2nd respondent herein on 20.08.2016.

The grievance of the petitioner in the present writ petition, as advocated by the learned counsel for the petitioner, is that though the petitioner filed the appeal as long back as on 20.08.2016, no orders have been passed on the said appeal nor the stay application is taken up. It is also clear from the material available on record that the petitioner
AVSS,J W.P.No.6773 of 2017 herein also filed an application seeking condonation of delay in filing the appeal.

Having regard to the submissions made by the learned counsel for the petitioner and learned Government Pleader, this Court deems it appropriate to dispose of the present writ petition by directing the 2nd respondent - Joint Collector, to pass appropriate orders on the same by fixing some timeframe.

For the aforesaid reasons, this writ petition is disposed of, directing the 2nd respondent - Joint Collector, to pass appropriate orders on the condone delay application dated 20.08.2016 and also on the appeal filed by the petitioner herein on the even date, in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. No order as to costs.
