THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.9530 OF 2016 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India for the following relief:

"to issue a writ, order or direction more particularly one in the nature of writ of Mandamus declaring the Memo.No. D(HR)/DGM(1-1R)/P0K/64/2016-1, dated 10.3.2016 issued by 2nd respondent where under his name has been referred to fresh District Selection Committee for the post of Fireman in Kothagudem Thermal Power Station-V Stage, Paloncha, Khammam District and to declare the aforesaid memo as illegal, arbitrary and violative of rights guaranteed under Article 14, 16 and 21 of the Constitution of India and consequently set-aside the same and pass such other order or orders as this Hon'ble Court may deem think fit and proper in the circumstances of the case."

2. Heard Sri V.Mallik, learned counsel, appearing for the petitioner and learned Government Pleader for Revenue appearing for the respondents.

3. When the matter is taken up, it is represented by the learned counsel for the petitioner that for redressal of the grievance of the petitioner, petitioner herein submitted a representation dated 18.03.2016 to the 2nd respondent and no orders have been passed on the said representation and a necessary direction may be issued to the 2nd respondent to pass appropriate orders on the said representation, in accordance with law, by fixing some timeframe.

4. Recording the said submission and having regard to the nature of controversy, Writ Petition is disposed of, without expressing any opinion on the merits and demerits of the matter and entitlement of the petitioner, directing the 2nd respondent to consider and pass

appropriate orders on the representation dated 18.03.2016 said to have been submitted by the petitioner herein, in accordance with law, within a period of two months from the date of receipt of a copy of this order.

5. Miscellaneous petitions pending consideration, if any, in the Writ Petition shall stand closed in consequence. No order as to costs. __________________ A.V.SESHA SAI, J 30.03.2016 SS
