This Company Application is filed for a direction to respondent No.1 to deliver vacant room to the auction purchaser- M/s.Anusha Constructions, to whom the property was sold in pursuance of Order, dated 21-08-2014, in Company Application No.315 of

2013 in Company Petition No.171 of 2011.

Respondent No.1- Official Liquidator has filed his report wherein it is inter alia stated that besides office records and computers, various other items of equipment as shown in Annexure B thereof are lying in the auctioned property.

Mr.M.Narender Reddy, learned Senior Counsel appearing for Mr.M.Srikanth Reddy, learned Counsel for the applicant, however, pointed out that as per the auction/sale notice, issued by the Official Liqudiator, all the movable properties such as plant & machinery, furniture & fixtures, office equipment & material etc., have been notified for sale; that they were, accordingly, sold out; and that therefore, the entire material that is lying in the room falls within the auctioned items. He has further submitted that his client has no objection for removal of the books along with the computers available in the said room by respondent No.1.

Mr.M.Anil Kumar, learned Counsel for the Official Liquidator, submitted that the Official Liquidator may be permitted to remove all the books and computers from the said room and shift them to

his office at Hyderabad.

The learned Senior Counsel for the applicant has fairly agreed for the applicant incurring the expenditure for such shifting.

The Company Application is, accordingly, disposed of with the direction to respondent No.1 to vacate the room purchased by the auction purchaser, by removing the books and computers therefrom with the expenditure of the applicant and hand over vacant possession of the same to the auction purchaser within four weeks from the date of receipt of this order.
