THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 3589 of 2018 O R D E R :

The case of the petitioner is that through an office order dated 22.01.2018, he was entrusted the work of maintenance of toilets at Kurnool Bus Station (Cluster-A & Cluster-B), but however, he is not being allowed to carry on the work, thereby depriving him of his livelihood.

Learned Standing Counsel for the respondent Corporation does not deny the factum of issuing the order dated 22.01.2018 to the petitioner.

As can be seen from the order dated 22.01.2018, the contract period is from 01.02.2018 to 31.07.2018. In those circumstances, as long as the work order granted in favour of the petitioner is subsisting and subject to the condition of his fulfilling the work to the satisfaction of the respondents, the petitioner cannot be prevented from discharging the contractual obligations. The Writ Petition is therefore, allowed with a direction to the respondent authorities to allow the petitioner to carry on the work entrusted to him during currency of contract period. No costs. Consequently, the miscellaneous Applications, if any shall stand closed.
