THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION NO.25529 of 2016 ORDER:

This Writ Petition is filed for the following relief: "...to issue a Writ or Order or direction more particularly in the nature of Writ of Mandamus, declaring the proposed action of the respondents in trying to take possession of the petitioner's schedule property admeasuring Ac.31-36 guntas in Sy.No.531/A situated at Devunoor village, Dharmasagar Mandal, Warangal District without due process of law as illegal, null and void and violative of Articles 21 and 300-A of Constitution of India as well as violation of principles of natural justice and for a consequential order to direct the respondents to drop all further proceedings in this regard including taking possession of the petitioner's schedule property admeasuring Ac.31-36 guntas in Sy.No.531/A situated at Devunoor village, Dharmasagar Mandal, Warangal District without due process of law and to pass such other order or others as this Hon'ble Court may deems fit just and proper in the circumstances of the case."

Heard learned counsel for the petitioner as well as learned Government Pleader for Revenue (Telangana).

This Writ petition is filed only on apprehension. Admittedly, as on date, no Notification has been issued under Land Acquisition Act, 2013 with respect to the land situated in Sy.No.531/A of Devunoor Village, Dharmasagar Mandal, Warangal District. Therefore, this Writ Petition is closed giving liberty to the petitioner to seek redressal as and when the cause of action arises.

Accordingly, this writ petition is closed. There shall be no order as to costs. Consequently, miscellaneous petitions, if any pending in this Writ Petition, shall also stand closed.
