THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.30070 of 2015 ORDER :

The petitioner claims to be the owner of house site admeasuring 200 square yards in Sy.No.204, near House No.18-144/4-12, Ward No.18, Shanthi Nagar Road, Narsampet, Warangal District. The petitioner applied for grant of building permission on 26.08.2013. But so far no permission is granted. Aggrieved thereby, the petitioner invoked the jurisdiction of this Court.

2. When the matter is taken up for consideration, learned Standing counsel, on instructions, submits that the reason for non-consideration of the application of the petitioner is that the petitioner did not observe the set backs.

3. At this stage, learned counsel for the petitioner submits that the petitioner will submit a fresh plan by observing the required norms and the same shall be considered by the Nagara Panchayat, Narsampet (2nd

respondent), within the time frame.

4. Having regard to the said submission, the writ petition is disposed of granting liberty to the petitioner to submit fresh plan, in addition to the application already submitted on 26.08.2013 and as and when such fresh plan is submitted by the petitioner, the 2nd respondent shall consider the building application dated 26.08.2013 and pass appropriate orders in accordance with the Rules governing building permissions within a period of two weeks from the date of submission of the fresh plan. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. __________________ P.NAVEEN RAO,J 15th September, 2015.
