SMT JUSTICE T.RAJANI CRIMINAL PETITION NO.1282 OF 2018 ORDER:
This Criminal Petition is filed seeking for grant of anticipatory bail to the petitioner, who is the accused in Crime No.382 of 2017 on the file of the Station House Officer, Gadwal TN, Police Station, Jogulamba Gadwal District. The offences alleged are under Sections 420, 406 and 120-B of the Indian Penal Code. Heard the learned counsel for the petitioner, learned Public Prosecutor appearing for the respondent-State, and perused the record.
As per the case of the prosecution, this petitioner, who was working as District Welfare Officer in the Department of WD & CW, colluded with others and misappropriated government money, by creating fake bills and illegally drawn an excess amount of Rs.77,57,535/-.
Counsel for the petitioner submits that in fact, this petitioner has been addressing letters to the CDPO with regard to the discrepancies in the accounts and with regard to the actual payment made towards supply of eggs. The letters are dated 11.05.2017, 18.08.2017 and 10.10.2017. Counsel for the petitioner also submits that a similar report was given to the Superintendent of Police by the petitioner.
On the other hand, learned Public Prosecutor submits that after receiving the letters, the CDPO had to make thorough enquiry with regard to the issue of allegations and hence, this complaint was filed in October, 2017. She also relies on the confessional
statement of A-2, wherein it is clearly mentioned about the role of this petitioner with regard to misappropriation of the amounts. With regard to the letter issued to the Superintendent of Police, learned Public Prosecutor submits that it is not an authenticated document and it cannot be considered. Hence, in the above circumstances, this Court opines that it is not a fit case for grant of anticipatory bail to the petitioner. However, the petitioner can surrender before the Court concerned and seek regular bail. On such surrender, the concerned Court is directed to consider the bail application of the petitioner on merits and in accordance with law, on the same day subject to the regular pressure of work.
With the above observation, this Criminal Petition is dismissed. Miscellaneous petitions, if any, pending shall stand dismissed.
