HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 13122 of 2002 ORDER:

This writ petition is filed seeking to issue a writ of certiorari calling for the record relating to and connected with I.D.No.170 of 1995 on the file of the 2nd respondent and quash the order dated 24.09.2001 passed therein, whereby the order of termination of the services of the 1st respondent herein dated 17.05.1983 was set aside and the petitioners herein were directed to reinstate the 1st respondent into service with continuity of service, but without back wages, holding it as illegal and arbitrary.

When the matter is taken up for hearing, it is brought to the notice of the Court by the learned counsel for the 1st respondent that in pursuance of the award of the Labour Court, dated 24.09.2001, the petitioners reinstated the 1st respondent into service. It is also brought to the notice of the Court that during pendency of the writ petition, the 1st respondent had expired in 2014. In the absence of the contesting respondent in whose favour the impugned award is passed, the writ petition cannot be adjudicated. Therefore, the writ petition is dismissed.
