Crl.Petition No.1191 of 2022 THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO. 1191 OF 2022 O R D E R:

This Criminal Petition is filed under Sections 437 and 439 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C.") seeking to enlarge the petitioner/Accused No.1 on bail in connection with Crime No.212 of 2021 on the file of Maripeda Police Station registered for the offence punishable under Section 8(c) read with Section 20 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the NDPS Act').

Heard Sri T.Sujan Kumar Reddy learned counsel for the petitioner, the learned Assistant Public Prosecutor for the respondent-State and perused the record.

Petitioner is arrayed as Accused No.1 in the aforementioned Crime. Petitioner/Accused No.1 and Accused No.2 were caught by the police for being in possession of 40 kgs ganja and thereafter they were remanded to judicial custody. Accused No.2 filed Criminal Petition No.387 of 2022 whereby this court was pleased to release the Accused No.2 on bail by order dated 25.01.2022.

The allegations against the petitioner/Accused No.1 and Accused No.2 are one and the same. In the said circumstances, the benefit of bail can be extended to the petitioner/Accused No.1. 5.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused No.1 is granted bail subject to the following conditions:

i) The petitioner/Accused No.1 shall execute a personal bond for a sum of Rs.20,000/- (Rupees Twenty Thousand Only) with two sureties for a like sum each to the satisfaction of Judicial First Class Magistrate at Thorrur, Warangal District.

ii) The petitioner/Accused No.1 shall personally appear before the investigating authorities on every Sunday between 08.00 AM and 11.00 AM for a period of two (02) months or till filing of the charge sheet, whichever is earlier.

As a sequel thereto, miscellaneous applications, if any pending, shall stand closed.
