HON'BLE SMT. JUSTICE T.RAJANI CRIMINAL PETITION No.1276 OF 2018 ORDER:

This Criminal Petition is filed by the petitioner/accused No.6 in Crime No.222 of 2017 on the file of the III Town Police Station, Nandyal, Kurnool District, for grant of anticipatory bail. The offences alleged are under Sections420, 478, 482, 483 and 487 read with 34 IPC. Heard the learned Counsel for the petitioner and the learned Public Prosecutor appearing for the respondent. Perused the record.

The case of the prosecution is that this petitioner was selling duplicate pesticides.

The name of this petitioner is not specifically mentioned in the report, but it is mentioned as one Venkateswarlu and even in the confessional statement of accused No.1, it is similarly mentioned.

Learned Public Prosecutor (AP) submits that the investigation is still in progress and until the role of this petitioner is brought out through the investigation, it cannot be said that this petitioner is not the said Venkateswarlu who is referred to in the complaint.

Hence, going by the facts of the case, this Court opines that this is not a fit case for grant of anticipatory bail to the petitioner. However, the petitioner can surrender before the Court concerned and seek regular bail. On such surrender, the concerned Court is directed to consider the bail application of the petitioner on merits and in accordance with law on the same day subject to the regular pressure of work.

With the above observation, the Criminal Petition is dismissed.

As a sequel, the Miscellaneous Petitions, pending if any, stand closed.
