THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.27234 OF 2017 O R D E R:

This Writ Petition has been filed seeking a direction to the 2nd respondent Investigating Officer, Vanasthalipuram Police Station to complete the investigation in Crime No. 859 of 2016, registered for the offences punishable under Sections 374, 403, 406, 420 and 509 of the Indian Penal Code and Section 3(1)(i)(p)(q) of the Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act, on priority basis, as per Rule 7(2) of the Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Rules, 1995. Heard learned counsel for the petitioner.

Learned Government Pleader for Home (Telangana) has produced before this Court, today, the copy of the written instructions issued by the Assistant Commissioner of Police, Vanasthalipuram Division, wherein, it has been stated as under: "

It is pertinent to submit that the investigation of this case is completed and proposals were submitted to the Commissioner of Police, Rachakonda Commissionerate on 14.08.2017 requesting him to accord permission to refer the case as 'lack of evidence'. Permission is awaited. As soon as the permission is received, final report will be filed in the Hon'ble Court as expeditiously as possible.

It is humbly submitted that the averments made in the affidavit filed in support of the writ petition are subject matter of investigation in Cr.No. 859 of 2016, for which, a detailed investigation is conducted, completed and proposals were submitted to the Commissioner of Police, Rachakonda Commissionerate on 14.08.2018 to refer the case of the complainant as 'lack of evidence'."

In view of the instructions received from the Assistant Commissioner of Police, Vanasthalipuram Division, the copy of which has been taken on record, the Writ Petition is closed. However, it is made clear that as and when the report is filed by the police, it is open for the petitioner to take steps in accordance with law. No costs.

Consequently, the miscellaneous Applications, if any shall stand closed.
