HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO W.P.No.583 of 2017

ORDER

Challenging the inaction of respondent No.3 in taking any action on the complaint made by the petitioners on 30.12.2016, the present writ petition is filed.

The Inspector of Police, III Town Police Station, Visakhapatnam, filed a counter-affidavit stating that the complaint was received on 30.12.2016, but on examination, they came to know that it is civil in nature and hence, advised the petitioners to approach the competent civil Court.

Learned counsel appearing for the petitioners submits that a reading of the complaint discloses commission of offence and the 3rd respondent should have taken note of the same. But, this Court is not inclined to examine the same as the petitioners have an alternative remedy.

In view of the same, the petitioners are given liberty to approach the competent civil/criminal Court for appropriate legal remedies.

Accordingly, the Writ Petition is disposed of. No costs. Miscellaneous petitions, if any, pending shall stand closed. ___________________________________ JUSTICE A.RAMALINGESWARA RAO 13th February, 2017 rkk[
