HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.30623 of 2015 ORDER:
The petitioner's request for grant of pattadar passbooks is under consideration as per the order of this Court in W.P.No.2357 of 2015, dated 06-02-2015. While considering the said request, the 3rd respondent has issued Memo, dated 27-052015 asking the petitioner to inform about the survey number, in which her land exists and also to produce documents relating to the said land within a week. Questioning the said Memo, the present writ petition is filed. Learned counsel for the petitioner relies upon the survey report and contends that the survey itself accepts that the petitioner is in possession of Sy.No.126. Hence, the impugned Memo asking the petitioner to inform about the survey number and also to produce documents is not tenable.
On instructions, learned Government Pleader states that the petitioner has only produced ordinary sale deed and hence, she was requested to file additional documents, if any. In that respect, the impugned memo was issued asking the petitioner on inform about survey number and also to produce additional documents. In the circumstances, therefore, since the 3rd respondent has to comply with the directions of this Court in the writ petition, referred to above, the petitioner is at liberty to produce documents, which she seeks to produce in support of her application filed under Form 6-A within two weeks from today before the 3rd respondent and the 3rd respondent shall thereafter consider the documents, if any, produced by the petitioner and verify the record and pass appropriate orders in accordance with law.
Accordingly, the writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending shall stand closed. _______________________
