O R D E R
The grievance of the petitioners is that the 7th respondent - Station House Officer, Gachibowli Police Station, at the instance of unofficial respondent No.8, is interfering with the civil dispute and also with their peaceful possession and enjoyment over the subject property.
The 7th respondent filed counter affidavit and stated inter alia that 8th respondent gave representation to respondents 4 and 5 - police authorities stating that the persons claiming to be the representatives of unofficial respondent No.8, are interfering with their possession over the subject property, and based on the said representation, the matter was entrusted for enquiry to the 7th respondent vide Endt.No.86/Mz-genl/ACPMdpur/Cyb/19 dated 23.02.2019, and in pursuance of the same, the 7th respondent enquired into the matter and the said enquiry revealed that there is a civil dispute between the petitioners and the 8th respondent and hence, he suggested the parties to approach the competent civil court for redressal of their grievance. It is stated that 7th respondent never interfered with the civil dispute or with the possession of the petitioners over the subject property.
No reply affidavit is filed.
Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for Home.
Recording the averments made in the counter affidavit, writ petition is disposed of directing the 7th respondent not to interfere with the civil dispute stated to be between the petitioners and the 8th respondent in respect of the subject property, except in accordance with law.
Interlocutory applications pending, if any, shall stand closed. No order as to costs.
