Heard learned counsel for petitioner and learned Standing counsel for respondent No.2.

This writ petition is filed aggrieved by rejection of candidature of petitioner for employment as Post Graduate Teacher in Biology in Kendriya Vidyalaya Sangathan. 3.

Learned Standing counsel, representing Kendriya Vidyalaya informs that it is one of the institutions notified under Section 14 (2) of the Administrative Tribunals Act, 1985 (for short 'the Act 1985') and the Central Administrative Tribunal has jurisdiction to adjudicate the grievances arising out of employment.

Since Central Administrative Tribunal is the Court of first instance as held by the Hon'ble Supreme Court in L. Chandra Kumar Vs Union of India1, petitioner has to avail the remedies provided by the Act, 1985.
