THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.19571 of 2009 ORDER:

1. This writ petition is filed seeking to declare the inaction of the respondents in making payment of Rs.5,30,000/- to the petitioner for the works done by him i.e., earth work of Perasi Tank and Singara Tank of Ramakuru village under Srama Daana Scheme, as illegal and arbitrary and consequently, to direct the respondents to make payment of Rs.5,30,000/- along with interest @ 18% p.a., to the petitioner

2. Heard and perused the material available on record.

3. The material on record does not disclose anything substantiating the claim of the petitioner that he has executed the work as stated by him in his affidavit. But, from some of the letters written by the authorities, it is found that some works were executed by the petitioner herein in Ramakuru village. In the said letters, it was also stated that there was no document available with them to verify as to whether such works were executed by the petitioner or not.

4. Considering the above circumstances, the writ petition is disposed of with the following direction:

a) The petitioner is at liberty to make a representation to the authorities concerned, placing reliance on any document, which is in his possession to substantiate that the work was executed by him. On such representation and the material being placed by the petitioner, the respondents herein are directed to consider the same and pass appropriate orders.

b) The respondents are also directed to verify as to whether any records are available in their office or the office concerned in connection with the works done by the petitioner at Perasi Rank and Singara Tank of Ramakuru village, and communicate the same to the petitioner.

No order as to costs. Consequently, the miscellaneous petitions pending, if any, shall stand closed.
