THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.1909 OF 2016 ORDER:
This Criminal Revision Case is filed under Sections 397 and 401 of the Code of Criminal Procedure (Cr.P.C.) aggrieved over the order, dated 03.05.2016, passed in S.C.No.125 of 2015 by the Court of the Special Sessions Judge-Cum-VII Additional District and Sessions Judge, Mahabubnagar, whereby the Court below directed the petitioner/A.5 to be tried for the charges framed against him.
Heard and perused the material available on record. This Court is of the view that truth or otherwise of the allegations made against the petitioner can be decided only after due trial. Hence, this Court is not inclined to interfere with the proceedings against the petitioner. Considering the facts and circumstances, and also as the question of identity of the petitioner does not arise, the presence of the petitioner is dispensed with before the Court below, except the dates on which the Court below insists for his appearance and also on the date of Judgment. The petitioner shall be represented through the counsel before the Court below on all hearing dates.
The Criminal Revision Case is accordingly disposed of.
