HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.4358 of 2020 ORDER :

This writ petition is filed aggrieved by action of the 5th respondent in refusing to receive and register the documents presented by the petitioner in respect of land in Sy.No.190/2 admeasuring 200 square yards situated at Pedda Ambarpet Village, Hayathangar Mandal, Ranga Reddy District on the ground that the subject property is included in the list of prohibited property under Section 22-A of the Registration Act.

Learned counsel for the petitioner submits in similar circumstances, this Court disposed of WP.No.17774 of 2019, dated 20-08-2019. The same is not disputed by learned Assistant Government Pleader for Revenue.

In view of the same, for the reasons alike in the order passed by this Court in WP.No.17774 of 2019, dated 20-082019, this writ petition is also disposed of directing the Registering authority to receive and process the documents submitted by the petitioner without reference to the District Gazette Notification dated 26-09-2013 subject to compliance of the provisions of the Indian Registration Act, 1908 and Indian Stamp Act, 1899. It is also open to the registering authority to refuse to register the documents presented before him, if he has any other objection, by duly assigning reasons

in support of such decision and communicate the said decision to the petitioner. It is made clear that mere registration of documents does not confer title to the property. It is also made clear that this order does not preclude the Government/District Collector to take appropriate steps as warranted by law and to assert its title. No costs. As a sequel, miscellaneous applications pending, if any, shall stand closed.
