THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR Writ Petition No.3219 of 2015 Order: (per the Hon'ble the Chief Justice Sri Kalyan Jyoti Sengupta) In our view, this petition under Article 226 is not maintainable on the allegation that the learned Family Court is not registering an application for execution of an interim order passed by the Family Court itself. According to us, it can be at the highest a case of failure of exercise of jurisdiction. Therefore, Article 226 cannot be invoked in this matter. We therefore close the writ petition keeping all points open. Consequently, the miscellaneous applications, if any pending, shall also stand closed. No order as to costs. __________________ K.J.
