THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4584 OF 2016 ORDER:
This Criminal Petition is filed by the petitioners-A2 and A4 under Section 482 Cr.P.C., seeking to quash the proceedings against them in FIR No.52 of 2016 on the file of Rajanagaram Police Station, Rajahmundry, East Godavari District, registered for the offence punishable under Sections 506, 420 r/w 120(B) IPC and Sections 3(1) (R )(s) and Section 3 (2)(Va) of the SCs and STs (POA) Act. Heard and perused the material available on record. It is alleged that in order to purchase a house site in the Lotus site at Rajanagaram, the 2nd respondent met all the petitioners and paid an amount of Rs.5 lakhs. On enquiry, the 2nd respondent came to know that the petitioners registered the same site in favour of another person. When the 2nd respondent along with his friend went to the site, all the petitioners abused him in the name of his caste and threatened him.
Learned Counsel for the petitioners submitted that the alleged incident took place on 13.2.2016 and the complaint was lodged on 18.2.2016.
Considering the facts and circumstances of the case, this Court is inclined to pass the following order:
The 1st respondent-police are directed to complete the investigation and file a final report, if any, in accordance with law, without arresting the petitioners. In the event of necessity, the 1st respondent-police are directed to issue notice to the petitioners for the purpose of investigation. On issuance of such notice, the petitioners are directed to appear before the investigating officer and give an undertaking as to their future appearance as and when required by the
