ORAL ORDER:

Heard learned counsel for petitioner and learned Government Pleader for Home for respondents 1 to 4.

Grievance of the petitioner is against freezing of his savings bank account bearing No. 916010005127642, Axis Bank Limited, Bapatla Branch, Andhra Pradesh. Material on record would disclose that on a complaint lodged against the petitioner, Crime No. 309 of 2018 was registered in Chaitanyapuri police station and on completion of investigation, police filed charge sheet. XI Metropolitan Magistrate, Cyberabad at L B Nagar took cognizance of the charges leveled and assigned C C No. 4817 of 2018, wherein petitioner is shown as Accused No.1.

Learned Government Pleader submits that in the process of investigation into the allegation leveled and having regard to the nature of allegations leveled, the bank account of the petitioner was freezed by the police.

It is not the case of petitioner that having regard to the nature of allegations, police do not have competence to freeze the bank account, as it is a case property. However, learned counsel for petitioner sought to contend that without prior notice and opportunity or leave of the competent Court, bank account of the petitioner could not have been freezed. This contention is not being considered at this stage, as petitioner has effective remedy to approach the XI Metropolitan Magistrate, Cyberabad at L B Nagar where C C No. 4817 of 2018 is pending. Thus, leaving it open to petitioner to take appropriate course of action regarding freezing of his bank account, writ petition is dismissed. No costs.
