THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.1323 of 2016

ORDER

This criminal petition under sections 437 and 439 of the Code of Criminal Procedure is filed by the petitioners-A1 to A3 seeking to grant bail in connection with Cr.No.28 of 2015 of Jaddangi Police Station, East Godavari District, registered for the offence punishable under Section 8(c) r/w 20(b)(c) of NDPS Act.

2. Heard the learned counsel for the petitioners and the learned Additional Public Prosecutor.

It is alleged that on 04.12.2015 at 4.00 PM., on information, the police officials rushed to the outskirts of Jaddangi village and found a van coming from Rajavommangi to Yeleswaram and on inspection, they found the accused in possession of 744 Kgs of ganja in 25 bags for the purpose of illegal transportation.

4. The petitioners are in judicial custody since 04.12.2015. Since the contraband seized from the possession of the accused is a commercial quantity, this Court is not inclined to grant bail to them. 5.
