THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.1400 of 2016 ORDER:

The petitioner filed the present Criminal Revision Case by invoking the provisions under Sections 397 and 401 of the Code of Criminal Procedure being aggrieved over the order, dated 10.05.2016, passed in Crl.M.P.No.1125 of 2016 in C.C.No.152 of 2016, by the VI Additional Chief Metropolitan Magistrate at Hyderabad. Heard and perused the material available on record. Petitioner is A-1 in C.C.No.152 of 2016. He filed the above application before the Court below for return of his passport, as with the help of his passport, it is easy for his son to get passport. The Court below allowed the said application through the impugned order on a condition to the petitioner to reproduce his passport before the Court within one month i.e., 10.06.2016 and he should not leave the country without permission of the Court and in any circumstances, if the petitioner leaves the country without permission of the Court, his bail stands cancelled.

Learned counsel for the petitioner submitted that the petitioner needs the passport for another period of six months till the enquiry is completed by the passport authorities and also informed that the petitioner is ready to surrender the passport after the enquiry is over by the concerned authorities.

Considering the said facts and circumstances of the case, as far as the condition that the petitioner should surrender his passport on 10.06.2016 is hereby modified and the petitioner is directed to surrender passport on or before 10.11.2016.

With the above directions, the Criminal Revision Case is disposed of. Consequently, miscellaneous petitions filed in this revision, if any, shall stand closed.
