THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.14491 of 2017 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is field by the petitioner being aggrieved of the Special Notice, dated 24.04.2016, enhancing the existing tax and demanding the tax assessed and arrears.

Heard learned counsel appearing for the petitioner and the learned Standing Counsel appearing for the 2nd respondent Municipality. 3.

Learned counsel for the petitioner submits that the petitioner submitted a representation for reducing the tax and that the if the writ petition is disposed of by giving a direction to the 2nd respondent Municipality to consider the said representation and pass appropriate orders in accordance with law, the grievance of the petitioner would be redressed. 4.

Learned Standing Counsel for the 2nd respondent Municipality endorsed the said submission.

Recording the said submission, the writ petition is disposed of directing the 2nd respondent to consider and dispose of the representation of the writ petitioner in strict accordance with the procedure established by law, as expeditiously as possible. Till such time, the petitioner shall continue to pay 50% of the enhanced tax regularly without fail. Pending miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
