HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.16460 of 2013 ORDER:

This writ petition is filed by the petitioners aggrieved over the action of the respondents in issuing notices dated 28.5.2013 seeking their dispossession from the lands in question.

It is the case of the petitioners that they are the bonafide purchasers of the lands in question and they have been in occupation of the same for the last several years by raising structures thereon. While so, the 3rd respondent sent the notices dated 28.5.2013 to all the petitioners individually, directing them to remove the structures within 15 days from the lands in question. Further, it is the case of the petitioners that the respondents with a malafide intention, without following due process of law, are trying to dispossess them.

When this matter has been taken up, the learned Government Pleader submitted that the notices impugned may be treated as show cause notices and if the petitioners intend to give their representation by way of reply to the said notices, the respondents are ready to consider the same and pass appropriate orders in accordance with law. 4.

In view of the above submission, without expressing any opinion on merits, this Court is inclined to pass the following order: "The petitioners herein are directed to give their representation to the respondents concerned by way of reply to the notices impugned, on or before 15th June, 2017. On such representation being made, the respondents concerned are directed to pass appropriate orders in accordance with law. Till such time,

the respondents are directed not to interfere with the possession of the petitioners herein over the lands in question." 5.

With the above direction, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed. ________________ RAJA ELANGO, J Date: 20th April, 2017 Nn
