HONOURABLE SMT JUSTICE T.RAJANI CRIMINAL PETITION No.1294 OF 2018 ORDER:
This Criminal Petition is filed by the petitioner/sole accused in Crime No.72 of 2017 on the file of the Kaikaluru (R) Police Station, Krishna District, for grant of anticipatory bail. The offences alleged are under Sections-409 and 477-A of IPC.
Heard the learned counsel for the petitioner and the learned Public Prosecutor appearing for the respondent. Perused the record.
The case of the prosecution is that the petitioner did not remit the amount which he collected as water tax from the ryots of Alapadu and Someswaram Revenue Villages and misappropriated the same.
Learned counsel for the petitioner submits that the alleged offence pertains to the period which is far from the date of filing the charge sheet. But, that shall not be a ground for granting anticipatory bail to the petitioner. The report itself shows that an enquiry has been conducted and that after the offence committed by the petitioner came to light, this complaint came to be lodged.
Hence, in view of the nature of the allegations, this Court opines that this is not a fit case to grant anticipatory bail to the petitioner.
However, the petitioner is at liberty to surrender before the Court concerned and seek regular bail. On such surrender, the concerned Court is directed to consider the bail application of the petitioner on merits and in accordance with law on the same day subject to the regular pressure of work.
With the above observation, the Criminal Petition is dismissed As a sequel, the Miscellaneous Petitions, pending if any, stand closed.
