THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.12052 of 2015 ORDER:

The writ petition is filed by the petitioners challenging the notification, dated 17.04.2015, detaining the petitioners to write B.Tech., III Year II Semester Examinations in the respondent engineering colleges.

Heard and perused the material available on record. The learned counsel for the petitioners submits that all the students, who are detained under the impugned notification, have got more than 50% attendance in the third year. He further submits that they are regularly attending the classes and without informing the students, the management of the respondent colleges have now changed the minimum percentage of attendance by the students from 50% to 55%, and as such, the notification is illegal and arbitrary. He prayed this Court to set aside the impugned notification and to permit the petitioners to write the examinations. On perusing the impugned notification, dated 17.04.2015, this Court is of the view that the said notification does not disclose any details with regard to the minimum percentage of attendance for allowing the students to write the examinations and how much percentage of shortage of attendance by the students, who are detained under the impugned notification, and as such, the said notification is bereft of any reasons.

In view of the facts and circumstances, the impugned notification, dated 17.04.2015, is set aside, and the respondents are directed to allow the petitioners to write B.Tech., III Year II Semester Examinations of various disciplines.

The writ petition is accordingly disposed of. Consequently, the miscellaneous petitions, if any shall also stand disposed of.
