THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.18549 of 2017 ORDER:

Heard Sri M.V.Raja Ram for petitioners and the Assistant Government Pleader (Revenue) for respondents 1 to 3. The learned counsel, after arguing for considerable length of time, having realized the difficulty in the light of proceedings Rc.B.1072/ 1991 dated 06-10-2015, seeks liberty of the Court to avail the remedy of appeal against the proceedings dated 06-10-2015 before the 2nd respondent.

This Court is of the view that the proceeding dated 06-10-2015 is certainly an appealable order. Hence, the petitioners are given liberty to avail the remedy of appeal in accordance with law within one week from today, by enclosing a copy of this order. If the appeal is filed in accordance with law, as permitted by this order, the 2nd respondent is directed to take up the stay application filed by the petitioners and pass orders within one week thereafter. The steps, if any, are taken by any person, the same are subject to further orders of the 2nd respondent. The writ petition is disposed of accordingly. No order as to costs.
