THE HONOURABLE SRI JUSTICE RAJA ELANGO TRANSFER CRIMINAL PETITION No.136 OF 2016 ORDER:

This Transfer Criminal Petition, under Section 407 read with 482 of the Code of Criminal Procedure, 1973, is filed to transfer D.V.C.No.53 of 2014 from the Court of the VI Additional Judicial Magistrate of First Class, Rajahmundry, East Godavari District to any other Court of Judicial First Class Magistrate at Hyderabad.

2. Heard and perused the material available on record.

3. Respondent Nos.2, 3 and 4 are the wife, daughter and son of petitioner No.1. They filed the D.V.C. against the petitioners seeking certain reliefs under the provisions of the Protection of Women from Domestic Violence Act, 2005.

4. After arguing for sometime, learned counsel for the petitioners while not pressing for the main prayer, confined his arguments only to the extent of dispensing with the presence of the petitioners before the trial Court.

5. In view of the same and also considering the nature of allegations wherein the question of identity of the petitioners does not arise, the presence of petitioner Nos.2 and 3/R-2 and R-3 before the trial Court is dispensed with except on the dates on which the learned Magistrate insists for their presence. However, petitioner No.1/R-1 shall appear before the trial Court on all hearing dates and also represent the other petitioners. The petitioners shall be properly represented through their counsel before the trial Court.

6. Accordingly, the Transfer Criminal Petition is disposed of.

Miscellaneous petitions pending, if any, in this Transfer Criminal Petition shall stand closed.
