I.A.No.1 of 2025 For being mentioned This application is filed seeking correction/modification of the judgment and decree dated 16.10.2024 passed in A.S. No. 406 of 2007, contending that while allowing the appeal and directing deposit of compensation, the rate of interest on the awarded amount was inadvertently omitted.

Learned counsel for the applicant submits that the omission is accidental and requires rectification in exercise of powers under Section 34 of the Code of Civil Procedure, 1908, as this Court is empowered to award interest on the compensation amount.

Upon perusal of the record and the judgment dated 16.10.2024, this Court finds that though compensation was awarded, no specific direction was issued regarding interest. The omission appears to be inadvertent and requires

Accordingly, the application is allowed.

The judgment and decree dated 16.10.2024 in A.S. No. 406 of 2007 shall stand modified to the extent that the applicants shall be entitled to interest on the awarded compensation amount at 9% per annum from the date of suit until the date of decree, and thereafter at 6% per annum from the date of decree till realization. The Registry is directed to carry out necessary corrections and issue a revised decree accordingly.
