HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION Nos. 4541 and 23268 of 2004 COMMON ORDER:

Since the issue involved in both the writ petitions is one and same, both the writ petitions are heard together and being disposed of by this common order.

In both the writ petitions, the petitioners seek promotion to the post of Leading Hand and contend that their cases may be considered for promotion to the said post on par with their juniors. Learned standing counsel for the respondent corporation contends that during pendency of the writ petition, the petitioners have attained the age of superannuation and, therefore, the cause in the writ petitions does not survive.

This Court having considered the said submission and perused the record is of the considered view that if the petitioners are aggrieved by the non-consideration of their cases on par with their juniors, they are at liberty to submit representations to the respondents within two weeks from the date of receipt of a copy of this order, and upon receiving such representations, the respondents shall consider and pass appropriate orders, in accordance with law, within four weeks thereafter.

With the above observations, both the writ petitions are disposed of.
