THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION NO.3564 OF 2017 ORDER:

This Criminal Petition is filed under Section 438 Cr.P.C. seeking to grant anticipatory bail in the event of arrest of the petitioner/A.11 in Cr.No.597 of 2016 of Nallapadu Police Station, Guntur Urban District, which was registered for the offence punishable under Section 302 IPC.

Heard both sides. Perused the record.

The allegations against the accused are that on the date of incident, accused took the deceased to Guntur Channel Canal at Budampadu Village where A.6 to A.8 and A.10 caught hold the deceased and A.1, A.3 and A.4 attacked him with iron rod and thereby caused his death. The role attributed to the petitioner-A.11 is that he watched the movements of the deceased and informed the same to other accused. 4.

Having regard to the gravity of the offence and the role attributed to the petitioner, this Court is of the view that it is not a fit case to consider the request of the petitioner for grant of anticipatory bail.

5. Hence, the Criminal Petition is dismissed.

6. Miscellaneous petitions, if any pending in this petition shall stand closed.
