HON'BLE SRI JUSTICE P.NAVEEN RAO W.P.No.4400 of 2019 ORDER:

Heard the learned counsel for the petitioner, learned Government Pleader for Panchayat Raj, appearing for respondent Nos.1 to 3 and Sri G.Navender Reddy, learned Standing Counsel for respondent Nos.4 and 5.

Alleging that the petitioner is involved in a crime, a crime was registered against him, he was arrested and was detained in custody. Taking due note of these developments, by the order dated 20-07-2018, the petitioner was placed under suspension. The same is under challenge in this Writ Petition. 3.

Later, the suspension was reviewed by order dt.02-02-2019 and having regard to the nature of offence in which the petitioner is involved, a decision was taken to continue the suspension period till the disposal of the Criminal Case. The petitioner is aggrieved by the said order also. 4.

It is not the case of the petitioner that the 4th respondentDistrict Rural Development Officer is not competent authority for placing him under suspension. On the reading of the order itself, it is clear that there was application of mind and the suspension was reviewed by taking due note of the allegation of involvement of the

PNR,J W.P.No.4400 of 2019 petitioner in the criminal case, which factor is not denied. Hence, I find no merit in the Writ Petition.

Accordingly the Writ Petition is dismissed. It is open to the petitioner to avail remedy of appeal against further continuation of suspension made by order dated 02-02-2019. No costs. 6.

As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
