THE HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.4617 of 2016 ORDER:

This Criminal Petition is filed under Section 482 of Code of Criminal Procedure seeking to quash the proceedings initiated against the petitioner/A-1 in Crime No.62 of 2016 of Korutla Town Police Station, Karimnagar District, registered for the offences under Sections 420, 406, 409 IPC read with section 34 IPC. Heard and perused the material.

On perusal of the entire material available on record, prima facie, there are allegations against the petitioners, which are to be investigated into by the police. Hence, this Court is not inclined to quash the proceedings at this stage.

Considering the facts and circumstances of the case, the petitioner is directed to surrender before the police concerned and to execute a bond for a sum of Rs.5,000/- (Rupees five thousand only) for his future appearance and the police are directed to complete investigation without arresting the petitioners and file final report, if any, in accordance with law. In the event of necessity, the police concerned are at liberty to issue a notice to the petitioner herein for the purpose of investigation and on receipt of such notice the petitioner herein shall appear before the police and cooperate with the investigating agency. In the event of failure on the part of the petitioner to appear before the police on receipt of such notice, the police are at liberty to approach this Court for recalling the present order.

The Criminal Petition is accordingly disposed of.

Miscellaneous Petitions pending in this Criminal Petition, if any, shall stand closed.
