Heard learned counsel for the petitioner and learned Government Pleader for the respondents 1 to 4.
The petitioner states that the land of an extent of Ac.3-74 cents, situated in Survey No.12 of Cheemalapalli village, Pendurthi Mandal, Visakhapatnam District, is a private land and the same does not belong to any religious institution. This is supported by an entry dated 14.12.1863 made in the Inam Fair Register. The land was originally granted as a Personal Inam in favour of one Hanumanchipalli Rangacharyulu and the same was alienated in favour of one Motamarri Sriramulu. The Inam was confirmed on payment of half of quit rent. The Inam was covered by Inam Title Deed No.1192 and the same is heritable and also alienable. The said Motamarri Sriramulu who purchased the property executed a registered settlement deed in favour of his daughters.
One of the daughters executed a registered sale deed in favour of one Ademma and she in turn executed a sale deed on 10.03.1942 in favour of Robert Alfred Kishander. The daughters of the said vendee executed a registered sale deed on 28.01.1971 in favour of the father of the petitioner. After the demise of the father of the petitioner, the petitioner became the owner of the said land. In spite of the above title, the land was included in the list of prohibited properties under Section 22-A (1)(c) of the Registration Act and for deletion of the said property the petitioner submitted a representation on 04.10.2016. When the same was not disposed of, the present Writ Petition is filed.
Learned Government Pleader submits that no acknowledgment of the representation dated 04.10.2016 is filed along with the material papers and there is no evidence of sending such representation. In the circumstances, the petitioner is given liberty to submit a copy of the said representation dated 04.10.2016 to the second respondent within a period of one week from the date of receipt of a copy of this order and, on receipt of the said representation, the second respondent shall consider the same and pass appropriate orders in accordance with law within a period of three (3) months thereafter. The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.
As a sequel thereto, the miscellaneous petitions, if any, pending in this writ petition shall stand closed.
