HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.4383 of 2019 ORDER:

The grievance of the petitioner is that the Revenue Divisional Officer, Medpally, Karimnagar District, has not disposed of his appeal filed under the provisions of the Telangana Rights in Land and Pattadar Pass Books Act, 1971, though the said appeal was filed as long back as in the year 2017.

In the light of the order proposed to be passed by this Court without going into the merits of the matter, it would not be necessary to put respondent No.4 on notice or afford him an opportunity of hearing.

Learned Assistant Government Pleader for Revenue, State of Telangana, does not dispute the fact that the petitioner's appeal has been taken on file and numbered as Appeal No.706 of 2017. That being so, it is not open to the statutory appellate authority to keep such an appeal pending indefinitely. The very purpose of providing a hierarchy of statutory remedies to the citizens would be rendered futile by such delay on the part of the authorities concerned in discharging their quasi-judicial functions. The Writ Petition is accordingly disposed of directing the Revenue Divisional Officer, Medpally, Karimnagar District, to consider the petitioner's Appeal No.706 of 2017 on its own merits and dispose of the same, after hearing all the parties, expeditiously and in any event, not later than three months from the date of receipt of a copy of this order, be it from whatever source.
