O R D E R

Sri Penumaka Venkata Rao, learned counsel for the petitioner, states that though the prayer in the writ petition is for reinvestigation, the endeavour of the petitioner is to seek further investigation by the police authorities in connection with Crime No.304 of 2012 on the file of III Town Police Station, Visakhapatnam City. He further states that the learned IV Additional Chief Metropolitan Magistrate at Visakhapatnam is seized of the matter as the charge-sheet has already been filed in relation to this crime.

As the matter is pending before the learned Magistrate concerned, it would be open to the petitioner to invoke the powers of the learned Magistrate under Section 173(8) Cr.P.C. (Vide order dated 16.12.2015 passed by this Court in W.P.No.10671 of 2013 and Criminal Revision Case No.1054 of 2013).

Reserving liberty to the petitioner to do so, the writ petition is closed. Pending miscellaneous petitions shall also stand closed in the light of this final order. No order as to costs. ______________________ SANJAY KUMAR, J 15th FEBRUARY, 2016 PGS
