THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.17129 OF 2016 ORDER:

Heard both sides and with consent of the counsel appearing for both sides, the present writ petition is disposed of at the admission stage.

2 . The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondents 2 to 4 in not taking action against the persons, who are resorting to encroach upon the public places by erecting huts earmarked for the park vide L.P.No.10 of 1982 of Pimala Nagar, Kurnool City, even though the respondents are duty bound to protect the public places by taking stringent action against any such encroachers by duly protecting the site by constructing compound wall/fencing etc., as illegal and arbitrary and consequently, to direct the respondents to take appropriate steps/measures for protecting the open space meant for park from the encroachers.

3. Though various grounds are raised in the writ petition, learned counsel for the petitioners restricts his prayer seeking a direction to respondents to consider the representation made by the petitioners on 19.05.2016.

4. Having regard to the circumstances stated above, the Writ Petition is disposed of directing the 2nd respondent to consider the representation dated 19.05.2016 made by the petitioner seeking protection of the land, in accordance with law, as early as possible preferably within a period of four (04) weeks from the date of

receipt of a copy of this order, after hearing all the necessary parties.

Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
