HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO W.P.No.21614 of 2016 ORDER:

Heard the learned counsel for the petitioners, learned Government Pleader for Higher Education appearing for 1st respondent and Sri C.Sudesh Anand, learned counsel for respondent Nos.2 to 5.

2. In this Writ Petition, the petitioners challenge the action of the 2nd respondent in not allowing petitioners to submit proposals for the purpose of fixation of fee for the block period 2016-17 to 2018-19 on the ground that the petitioners have failed to submit the proposal within cut off date.

Learned counsel for the petitioners states that the petitioners are willing to pay the late charges, processing fee and all other charges for consideration of the petitioners' application for fixation of fee for the above period.

The learned counsel for 2nd respondent states, on instructions, that 2nd respondent will consider any proposal made by the petitioners subject to the petitioners complying with all the formalities prescribed by 2nd respondent and they should make payment of stipulated charges and fee and also upload data. 5.

Therefore, The Writ Petition is disposed of

directing the petitioners to furnish its proposals for fixation of fee for the above block period to the 2nd respondent within ten days from today and also upload whatever data is necessary for the said purpose along with late fee, processing fee and any other charges which may be demanded by 2nd respondent for late submission of its fee proposal of the above block period. Thereafter, 2nd respondent shall consider the same on merits in accordance with law within six weeks from the date of submission of such a proposal by the petitioners. No costs.

As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
