Vishnusree Educational Development Adhyayan Society, v. State Of Telangana,
THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION NO.1928 OF 2017 ORDER:
Heard the learned counsel for the petitioners and the learned standing counsel for the respondents 2 and 3. 2.
The case of the petitioners is that the 1st petitioner is a society, which is running 2nd petitioner institution. 3rd petitioner is the Secretary. The sanctioned strength for the 2nd petitioner institution is 60 students for Civil Engineering and Electrical and Electronic Engineering (EEE) apart from various other branches. The 2nd petitioner was allotted only one candidate for the EEE branch during the academic year 2016-17 and the remaining seats were handed over to the management to be filled under left over category. The spot admission were conducted and the 2nd petitioner could fill up only one local student for EEE branch. Four other seats were filled up by out of State students and they were admitted on 15-07-2016.
The last date for uploading the spot admission through online was on 22-07-2016 and submission of hard copies was on 25-07-2016. Though the students from out of State were admitted on 15-07-2016, the information was not uploaded as the staff of the college did not inform the management till 26-11-2016. Immediately on 21-11-2016 the details were submitted to the 3rd respondent for ratification as uploading through online was not possible as the server was closed. The said ratification was rejected by the 3rd respondent on 07-12-2016. Challenging the same, the present writ petition is filed. 3.
A counter-affidavit is filed on behalf of the respondents 2 and 3 stating that the notification for conducting the spot admission was made on 10-07-2016 and the vacant seats were supposed to be filled on 21-07-2016. The applications for spot admission were supposed to be commenced from 14-07-2016 and the management is supposed to submit the details of the admitted candidates on 23-07-2016. The details have to be submitted through online only. The schedule for spot admission was
communicated to various managements through Website and News papers and most of the managements have submitted the details of the candidates who were given admission under spot admission within the stipulated time. The very fact that the management did not submit the list even after four months from the cut off date shows that they have filled seats only after 21-07-2016, which is against the rules. In case of filling up of the seats after stipulated date, the students will not be in a position to fulfil the minimum requirement of 180 working days.
4.
In the light of the above facts, the feeble plea taken by the learned counsel for the petitioners that the staff of the college did not place the information before the management cannot be accepted. It is for the management to know the dates and the dates were widely published by the respondents 2 and 3. The reasons for submitting the details on 21-11-2016 after four moths from the last date of furnishing the details is not convincing. In view of the same, this Court is not inclined to entertain the writ petition.
5.
Accordingly, the writ petition is dismissed. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
