THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO WRIT PETITION No. 1522 OF 2015 O R D E R:

The petitioner, who was employed as a Conductor with the 1st respondent Andhra Pradesh State Road Transport Corporation attached to its Depot at Mydukuru in Kadapa District, has been subjected to medical examination on 18.06.2014. The medical examination declared him as unfit for A2 category, the standard of medical fitness required to be possessed by the conductors. The finding of the Senior Medical Officer declaring the petitioner as unfit for A2 category is not the subject matter of challenge, inasmuch as he has not subjected himself for examination by any medical board constituted in any teaching hospital, which has tendered a contrary opinion. Therefore, the Corporation has required the petitioner to give his consent for retiring on medical unfitness grounds.

The petitioner appears to have submitted a representation to the Regional Manager, APSRTC, Kadapa on 14.08.2014, seeking alternative employment as an Attender or Shramik. It is for the Regional Manager to consider the same and take an appropriate decision as to whether with the kind of medical fitness standard possessed by the petitioner now, whether he is suitable for employment as an Attender or Shramik and if he is found suitable, his case may be considered for an alternative employment. However, the petitioner shall exercise his final opinion with regard to the retirement from service as a conductor within a maximum period of 30 days from today within which period, the Regional Manager will also take a decision with regard to his suitability for the alternative employment.

With this, the Writ Petition stands disposed of. No costs. Consequently, the miscellaneous applications, if any shall also stand disposed of.
