The Court made the following Order:

This criminal petition, under Sections 437 and 439 of Cr.P.C., is filed by petitioner/A5 in Crime No.145 of 2016 of Bommuru Police Station, Rajamahendravaram District, seeking bail.

The offences alleged against the accused are under Sections 8 (c) read with 20(b)(ii)(c) of NDPS Act, 1985. 3.

Heard learned counsel for petitioner, learned Additional Public Prosecutor for the respondent-State and perused the record. 4.

The Public Prosecutor and the counsel for petitioner submit that A1 to A4, who faced trial, were acquitted by virtue of the judgment dated 14.07.2017 in S.C.No.181 of 2016 on the file of I Additional Sessions Judge, Rajamahendravaram. The Public Prosecutor also submits that no contraband was seized from the possession of the petitioner/A5.

In the circumstances, this Court is inclined to grant bail to the petitioner/A5.

Accordingly, the Criminal Petition is allowed. The petitioner/A5 is enlarged on bail on condition of his executing a personal bond for a sum of Rs.20,000/- (Rupees twenty thousand only) with two sureties for a like sum each to the satisfaction of the I Additional District and Sessions Judge, Rajamahendravaram.

Miscellaneous applications, if any, pending in this criminal petition shall stand dismissed.
