HON'BLE SRI JUSTI CE A.RAMALI NGESWARA RAO Writ Petition No.3684 of 2018 Order:
The petitioner states that he is the owner and possessor of agricultural land of an extent of Ac.0-86 cents, situated in Survey No.113 of Mothadaka village, Tadikonda Mandal, Guntur District. The Pattadar Passbooks and Title Deeds were also issued to him in respect of the said land. He states that an extent of Ac.1-72 cents, which includes the land of the petitioner, was originally assigned to one Valaparla Daveedu on 06.02.1923 by the then Province of Madras. The said Deveedu gifted the said land to his daughter on 21.08.1934 and she sold the land to Koppula Yesepu on 09.09.1943. The said Yesepu is the paternal grand father of the petitioner. His sons partitioned the property and the father of the petitioner came into possession of Ac.0-86 cents.
In spite of the above title, the property was included in the list of prohibited properties under Section 22-A (1)(a) and (e) of the Registration Act, 1908 (for short 'the Act'). The petitioner submitted a representation to the District Collector on 11.07.2017 seeking deletion of the said property and, when no action was taken on the said representation, the present Writ Petition is filed. Now, it is stated that a committee is constituted for dealing with the issues relating to deletion of properties which were included under Section 22(1) of the Act and in view of the same, the petitioner is given liberty to submit an appropriate representation to the said committee for deletion of the above property under Section 22(1) of the Act.
As and when such representation is filed, the committee shall consider the same and pass appropriate orders thereon within a period of three (3) months from the date of filing such representation.
The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.
As a sequel thereto, the miscellaneous petitions, if any, pending in this writ petition shall stand closed.
