No representation for the petitioners.

The writ prayer is for Mandamus declaring the inaction in giving preference to the petitioners for filling up the posts of Junior Linemen, as illegal and arbitrary.

The respondent filed counter affidavit. Paragraph 4 reads as follows:

"It is submitted that after the writ petition is filed, the respondent-Corporation has issued revised notification dated 26.10.2006 duly revising the criteria for selection on the basis of directions of the Hon'ble Court. As per the revised notification dated 26.10.2006, preference is indicated under paragraph 6 (iv)(a) wherein the presently serving contract labour who are manning sub station as on the date of issue of 1st notification dated 06.06.2006 would be given preference. It was also specified at para 6 (iv)(b) that if a contract labour and fresh candidates apply for the post, the contract labour will be given preference. In view of the revised notification the grievance of the petitioners did not survive. The candidature of the petitioners would be considered in light of the revised notification."

The stand of respondent discloses that the grievance does not survive and the case of petitioners will be considered in accordance with revised notification. The statement is placed on record and the writ petition is dismissed as infructuous. No order as to costs.
