This Criminal Petition, under Section 482 of the Code of Criminal Procedure, 1973, is filed by the petitioner/ accused to quash the proceedings in C.C.No.816 of 2017 on the file of IV Additional Junior Civil Judge-cum-XII Additional Metropolitan Magistrate, Kukatpally at Miyapur, Cyberabad, registered for the offences punishable under Sections 354D & 509 of IPC.

Heard the learned counsel for the petitioner/ accused, the learned Additional Public Prosecutor representing the 1st respondentState and perused the record. 3 .

The learned counsel for the petitioner/ accused would submit that there are no allegations against the petitioner/ accused constituting offences punishable under Sections 354D and 509 of IPC. However, the subject charge-sheet was filed. The investigating officer did not collect the 'Secret Page'

by which the petitioner/ accused allegedly committed the offences and ultimately prayed to allow the application.

On the other hand, the learned Additional Public Prosecutor opposed for the relief sought by the petitioner/ accused contending that there are statements of the victim as well as the witnesses to substantiate the accusations levelled against the petitioner/ accused and ultimately prayed to dismiss the application. 5 .

As per the record placed before this Court and the statements of the independent witnesses, there are specific and grave allegations

against the petitioner/ accused constituting offences punishable under Sections 354D and 509 of IPC. At this stage of dictating the order, the learned counsel for the petitioner/ accused seeks permission to withdraw this Criminal Petition. As far as the Criminal Petition is concerned, there are no merits to consider the same. Since a request is made to withdraw this Criminal Petition, this Criminal Petition is dismissed as withdrawn.
