HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 23489 of 2002 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the inaction on the part of the respondent corporation in absorbing the petitioners in any suitable post in terms of B.P.Ms.No.36 dated 18.05.1997, as illegal and arbitrary. It has been contended by the counsel for the petitioners that the petitioners are claiming absorption under B.P.Ms.No.36 dated 18.05.1997.

Learned standing counsel for the respondent corporation contends that the said B.P.Ms.No.36 was withdrawn and, therefore, the case of the petitioners cannot be considered. Having considered the submissions made by the parties, this Court is of the considered view that no direction can be issued to the respondents to absorb the petitioners under B.P.Ms.No.36 dated 18.05.1997 as it was subsequently withdrawn. Accordingly, the writ petition is dismissed.
