Devandla Subbarayudu v. V.Vinay Chand
THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE M. GANGA RAO Contempt Case No.275 of 2018 JUDGMENT: (Per the Hon'ble The Acting Chief Justice Ramesh Ranganathan) The order of this Court, violation of which is alleged in the Contempt Case, required the petitioner-appellant to prefer an appeal to the District Collector and for the District Collector to consider the same and pass orders thereupon in accordance with law, as expeditiously as possible, preferably within ten days from the date of filing of the appeal. The appeal is said to have been filed on 06.11.2017. Though as per the order of this Court it was required to be passed by 17.11.2017, the District Collector passed the appellate order on 23.02.2018. There is a delay of nearly four months in passing the appellate order. While the order of this Court has, no doubt, not been complied within the stipulated time, we see no reason to proceed against the respondent-contemnor, as he has tendered his unconditional apology.
The Contempt Case is, accordingly, closed.
The miscellaneous petitions, if any pending, shall also stand closed. There shall be no order as to costs.
