THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.842 of 2017 ORDER:
The petitioner who is A1 filed the present application under Sections 437 and 439 of the Code of the Criminal Procedure (Cr.P.C.), seeking enlargement on bail in Crime No.67 of 2014 of Chintapalli Police Station, Visakhapatnam District, registered for an offence punishable under Section 20(b) of NDPS Act. The case of the prosecution is that on 14.10.2014 at about 06.00 hrs. LW9 stopped the accused at market yard, Chowdupalli Village, along with his staff and found the accused in possession of 160 Kgs. of ganja packed in 80 packets. Basing on the said search and seizure, the above crime came to be registered. Heard learned counsel for the petitioner and learned Public Prosecutor appearing for the respondent-State and perused the records. The material placed before the Court would show that the petitioner is cultivator of ganja and he has been supplying the same for circulation. Apart from that, it is to be noted that the petitioner is involved in many cases and he has been produced in the case on PT Warrant.
Having regard to the fact that the petitioner is involved in number of cases which is revealed from the material on record, I am not inclined to grant bail to the petitioner. But, however, the trial Court is directed to dispose of the Sessions Case, as early as possible, preferably within a period of three months.
