Konda Rani v. The State Of Telangana

2019-03-05Sanjay Kumar2 pages

HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.4440 of 2019 ORDER:

The grievance of the petitioner is that the revenue authorities are not taking any steps upon her application filed for conversion of land use in relation to an extent of Acs.3.00 guntas in Survey No.345/4 of Mancherial Village, Mancherial District. Learned Assistant Government Pleader for Revenue, State of Telangana, would state that he is instructed to inform this Court that the petitioner has no locus to make such an application as the subject land is an assigned land.

This Court does not propose to go into the merits of the case at this stage as the only complaint of the petitioner is as to the inaction on the part of the revenue authorities upon her application. Perusal of the record reflects that the petitioner submitted an application online in the prescribed format for conversion of land use in relation to the subject land. It is for the competent authority, viz., the Revenue Divisional Officer, Mancherial Division, Mancherial District, to take approbation action upon the petitioner's application in accordance with law. Such an application cannot be kept pending indefinitely keeping the petitioner in suspense. The Writ Petition is accordingly disposed of directing the Revenue Divisional Officer, Mancherial Division, Mancherial District, to take appropriate action upon the petitioner's online application for conversion of land use in relation to the subject land on its own merits and in accordance with law expeditiously and in any event,

SK, J WP.No.4440 of 2019 Dt:05.3.2019 not later than four weeks from the date of receipt of a copy of this order, be it from whatever source.

Pending Miscellaneous Petitions, if any, shall stand closed in the light of this final order. No order as to costs. ________________________ JUSTICE SANJAY KUMAR 05th March, 2019 dr
